Opportunity This factor refers to the individual having access to, creating or seeking situations that provide him with potential opportunities to offend. It should be recognised that the type of situation will vary for each offender according to their offence preferences and that some men do not appear to plan their offending in advance but rather resort to offending when a suitable situation arises. In order to understand the context in which he could offend, you will need to have considered victim preferences, motivating factors, and offence triggers. Priority RatingHigh PriorityRating indicates a strong presence of this factor. There is a significant concern and urgent action is necessary. Examples: Actively seeking victim access: behaviours/decisions systematically increase victim access or is intended to open up circumstances that facilitate offending.Medium PriorityRating indicates only the partial presence of this factor. Examples: Some evidence of him engaging in activities that might be risky but the circumstances do not appear to be motivated directly by a desire to offend. Sexual Preoccupation Sexual Pre-occupation is defined by the individual’s behaviour and thoughts being more focused on sex than anything else in their lives. It has been described as an obsession, where the individual is so engrossed in sexual fantasy and thoughts that normal every day functioning is disrupted. A Sexual Pre-occupation with offence related thoughts or fantasies has been found to have a direct influence on further sexual offending and should be given extra weight when considering the priority rating. This may be derived from self disclosure and corroborated through environment and activity.Medium PriorityRating indicates only the partial presence of this factor. Offence Related Sexual Interests This risk involves sexual interests that are more easily gratified through offending than through legal consensual sexual activities. Often such evidence is drawn from admissions of offence related fantasies or thoughts but attention should also be paid to the indirect expressions such as seeking activities that may provide evidence that they hold offence related sexual interests. Such thoughts when associated with a sexual pre-occupation should be given extra weight when arriving a priority rating. Priority RatingHigh PriorityRating indicates a strong presence of this factor. Emotional Congruence with Children There is evidence of him finding it easier to satisfy needs for friendship, emotional intimacy and romance with children rather than adults. It may involve feeling “in love” with a child, wanting to spend large amounts of time with children and/or developing interests that are shared by children. With regard to this factor a child is defined as a person under 14yrs of age. Priority RatingHigh PriorityRating indicates a strong presence of this factor. There is a significant concern and urgent action is necessary. Examples: Clear indicators of wanting friendships, emotional intimacy or ‘romance’ with a child under 14 while showing lack of interest in these kinds of relationships with adults.Medium PriorityRating indicates only the partial presence of this factor. Hostile Orientation The risk involves a negative orientation to others or to rules. Hostility may present itself in a number of ways but will often include issues such as grievance thinking, callousness and general hostility. He may present hostile attitudes on women, a sense of entitlement and/or hold vengeance themes. He has a disregard for rules, intentionally breaks them with little regard to consequences. He consistently fails to meet appointments or may intentionally seek to make it difficult for professionals to engage in a meaningful way. Poor Self-Management This risk factor can be characterised by a chaotic and impulsive lifestyle resulting in stress, boredom, reckless choices and intentional exposure to negative influences. He is poor at regulating feelings and lacks ability to cope with life’s problems or to plan effectively. He fails to take responsibility for his actions and resorts to blaming others for his problems. He may look to others to find solutions and struggles with positive self-motivation. Priority RatingHigh PriorityRating indicates a strong presence of this factor. There is a significant concern and urgent action is necessary. Examples: His lifestyle is predominantly chaotic and impulsive. He seems unable to find constructive ways to manage problems or to put constructive solutions into place; he seems to be unable to regulate his feelings. He lacks motivation to make a change for good.Medium PriorityRating indicates only the partial presence of this factor. There is some concern and action may be required. Examples: A significant problem in one or more lifestyle areas but lifestyle is not predominantly problematic. Making changes to his life is difficult and whilst attempts to do so are well intentioned they often fail. Social Influences The protective dimension of this factor refers to the extent of pro-social support networks in the individual’s life that could influence him in a positive way. This network involves people whom the individual has significant contact with, whom he values / respects, who provide him with social or practical support when they aren’t paid to. It may include family members, friends and acquaintances that he regularly spends time with. The risk dimension of this factor refers to the relative predominance of anti-social people in the individual’s life that could have a negative influence on him. Such a network is composed of people who approve of or tolerate anti-social or criminal behaviour or who provide assistance in the commission of crimes. Priority RatingHigh PriorityRating indicates anti-social individuals exert a strong influence. It is likely to have a significant risk effect. Examples: Social network contains a clear predominance of negative influences. These influences have a negative effect.Medium PriorityRating indicates a balance between anti-social and pro-social influences or no strong social influences are exerted. It is likely to have only a small or limited protective or risk effect. Examples: Social network contains a balance between positive and negative influences with neither being able to exert influence. There are indicators of positive or negative influences but time is required to test the influence they have on them.Low PriorityRating indicates pro-social individuals exert a strong influence. It is likely to have a significant protective effect. Examples: Social network contains a predominance of positive influences and there is evidence this has a positive effect upon him. 8. Commitment to Desist This Protective Factor involves him having identified a pro-social (non-offender) sense of who he is (or is becoming). He has made practical steps to change and change can be evidenced. He wants to distance himself from the past and seeks out change related activities and works hard at achieving them. He has adopted realistic positive and meaningful life goals and has taken practical steps towards achieving them. He may continue to blame external events/circumstances for his crimes, or he may maintain denial of offences. However, he is able to identify differences between the self at the time of the offending and the self at the present time. He can account for his criminal past in a way that enables him to move on with his life in a positive way. Priority RatingHigh PriorityRating indicates this factor is not present. There is no protective effect. Example: Evidence of resistance or lacking scope or motivation for change.Medium PriorityRating indicates only the partial presence of this factor. It is likely to have only a small or limited protective effect. Example: Some measurable evidence of efforts to become a better person but further work is required.Low PriorityRating indicates a strong presence of this factor. It is likely to have a significant protective effect. Example: Strong evidence of efforts to become a better person or evidence of actual change. 9. Intimate Relationship An intimate relationship involves a level of closeness, shared understanding and positive involvement not found in normal social acquaintances. The protective influence of this factor involves him having a close, valued and meaningful intimate relationships with pro-social others. The person really knows him and provides healthy emotional and practical support that is congruent with supporting positive change. Whilst the protective nature of this factor generally relates to spouses and partners it is possible to have an intimate relationship with a close family member as long as contact is regular and so significant that it breaks up the routine of a pro offending environment or thoughts. The risk influence of this factor relates to individuals who have no intimate relationships or to those that have relationships but they involve repeated conflict and/or infidelity. Those that desire intimacy but are unable to achieve it are argued to be at an even more increased risk, as are those that do not desire intimacy.  High Priority Rating indicates an absence of intimate relationships. It is likely to have a significant risk effect. Example: Does not desire an intimate relationship or the relationships are conflicted and/or involves periods of infidelity. Medium PriorityRating indicates some degree of intimate relationships exists. It is likely to have only a small or limited protective or risk effect. Example: The relationship whilst having some elements of intimacy does not appear to exert any significant emotional or practical influence on the individual.  Low PriorityRating indicates the existence of intimate relationships. It is likely to have a significant protective effect. Example: The individual is involved in meaningful and appropriate intimate relationships that exert a positive emotional influence. 10. Employment or Positive Routine The core nature of this factor relates to employment; particularly where it brings the individual into contact with pro-social or conventional others. In order to act as a protective factor the employment needs to have a meaning for the offender beyond simply being a means of making a living. Given the nature of the protective element of this factor it is possible to extend it to cover any meaningful activity and routine that can provide a sense of purpose, agency and mastery. Priority RatingHigh PriorityRating indicates this factor is not present. There is no protective effect. Example: Not employed and shows little desire or motivation to become so. His life is unstructured and he suffers from long periods of boredom. His life lacks a sense of routine or positive purpose and there is no evidence he seeks to change this.Medium PriorityRating indicates only the partial presence of this factor. It is likely to have only a small or limited protective effect. Example: Evidence of short periods of employment or positive routine but although appearing motivated he is unable to sustain this. OR No employment or a positive sense of routine but the individual is actively seeking employment or a rewarding routine in an appropriate and constructive manner.Low PriorityRating indicates a strong presence of this factor. It is likely to have a significant protective effect. Example: In steady employment or his lifestyle is structured with a positive sense of routine and purpose. There is evidence that the individual finds this rewarding and has achieved a level of mastery or agency.11. Social Investment - ‘Giving Something Back’ The evidence suggests that when people reach a level of psychological maturity then they tend to want to ‘give something back’ or to contribute to future generations and are arguably therefore more likely to desist. Whilst there is little evidence that a lack of victim empathy is a predictor of future recidivism, it is believed that people who feel and show concern and demonstrate empathy for others are more likely to desist from crime. Offenders, who find ways to contribute to society, their community, or their families, appear to be more successful at giving up crime. For instance, the opportunity to mentor, assist or enhance the life of other people can enhance self esteem, contribute to feelings of agency and mastery and help to promote positive relationships with pro social others. If these achievements are formally recognised, the effect may be even stronger. Priority RatingHigh PriorityRating indicates this factor is not present. There is no protective effect. Example: Lacks motivation or commitment to engage with society in a meaningful way. Lacks compassion for others and fails to appreciate how people can contribute positively to society.Medium PriorityRating indicates only the partial presence of this factor. Example: Has some motivation and a desire to make a meaningful contribution to society but lacks the skills to engage appropriately or is readily frustrated by attempts to do so; OR Having previously contributed something meaningful to society there is a sense of loss and a desire to achieve it again.Low PriorityRating indicates a strong presence of this factor. It is likely to have a significant protective effect. Example: Is motivated and there is evidence of making some form of contribution to the good of society. Evidence Assessment Summary: 1. Opportunity I have reviewed his previous ARMS, taking note of many of the accurate comments regarding to his maturity in terms of his outward comments about females. ALBERONE is not in contact with any person, he keeps himself to himself and if not seeking any relationships or on any dating applications. He states he has been viewing pornography on torrent sites with filenames of SCHOOL, TEEN, STEPDAUGHTER. I suspect ALBERONE’s likeliness to re-offend by contact is minimal however he is likely to offend online using his TORRENT type applications. Despite being advised on multiple occasions this could cause an issue. I believe this is currently a high risk and specific actions have been listed to monitor/manage this and as such I will grade this as MEDIUM RISK. I have discussed this concerning factor with Alberone directly after several weeks of conducting this visit and discussed the fact that this needs to be addressed. Without this prompt intervention I suspect ALBERONE would have carrier a general risk management rating as high. ACTIONS: HIGH PRIORITY: Continue to explain the dangers of torrent sites. HIGH PRIORITY: Continue to discuss the dangers of his current search terms. 2. Sexual Preoccupation ALBERONE is describing himself as only masturbating weekly and fails to detail how much Pornography he is viewing this is most likely due to it be a sporadic part of his life. He’s detailed himself as not specifically watching material but just skimming through videos to ensure he find/watches the bit he enjoys. ALBERONE detailed himself as trying to abstain from Viewing pornography and masturbating, but he is taking one day at a time and is struggling. There was no relevant internet history to support his on his browsers to assist officers in identifying patterns, his torrent apps appeared clear of material, and this is most likely due to ALBERONE deleting the material once viewed as he mentioned this to me. With no evidence to the contrary I would suggest that ALBERONE’s risk factor presents as a LOW, however there is MEDIUM ACTION to further discuss this, review device history more effectively, 3. Offence Related Sexual Interests ALBERONE doesn’t appear to be wanting to communicate with others in a similar manner to his offence past, and he isn’t seeking to engage in any indicative or unlawful communications. ALBERONE has communicated that he has sexual fetishes that are “purely fantasy” for school girls, teens and step daughter type videos. This is highly risky for ALBERONE as it maintains offence related target age ranges. I believe that this is a MEDIUM RISK factor due to the information obtained on this second engagement. There is a risk that if this is left unchecked or unresolved this may increase in risk. The actions points for this factor remain the same for risk factor- opportunity. 4. Emotion Congruence with Children No changes since last assessment, LOW RISK 5. Hostile Orientation No changes to the information, however due to ALBERONE’s method of engagement where he repeatedly challenged officers when asking for devices even to the point where he was willing to be arrested to prove a point of him disagreeing with my forensic actions. I believe that a MEDIUM RISK RATING is appropriate as he complies with requests only once he has repeatedly been asked or directly challenged. This appears that he is just wanting to exercise his rights to privacy and feels that police may be abusing their powers and he wants a detailed explanation/understanding actions more before police conduct their triage/inspections. His communication with professionals is consistent and he takes time from professionals asking what appears to be repeated questions expecting different results not trusting the advice given. ALBERONE is contrite about his past, understands his predicament and admits to offences. He is known for assault offences, DV, weapons and this demonstrates there is a risk of hostility however this appears to stem from MH issues and when a lack of communication at his desired pace is presented to him. I get no sense that his manner or behaviour is tactical or an attempt to evade, deflect or distract. I rate this category at Low with the understanding that ALBERONE takes more time/effort than other people to explain factors and on occasions the time he needs is not available and sustainable and may cause an increase in this risk factor. 6. Poor Self-Management No changes- MEDIUM ACTIONS: HIGH: continue to discuss opportunities for routine/daily structure 7. Social Influences Rocky is very isolated, living alone, with the only recent change being that he is now engaging several times a week with a LATTER-DAY SAINTS chapel this includes him attending session in a virtual capacity. This has been the case since the relationship with Sally broke down and his hermit like existence causes me to question how/where he is likely to meet other people. He infrequently sees his STEP-SON once a week, who is a 19yr old male where they play on the playstation together. However this appears to have changed on my second engagement due to the divorce process. When discussing this in detail ALBERONE spoke about his cousin being someone he can talk to, even though I grade this one person as a positive influence- there is still a higher proportion of his time spend being alone and as such I rate this category at High. ACTIONS: HIGH: Continue to discuss opportunities for routines that allows him to engage safely with others LOW: Continue to discuss his involvement with the LATTER DAY SAINTS COMMUNITY as this may offer him an opportunity to socialise with PRO-SOCIAL PERSONS. 8. Commitment to Desist Previously reported: Rocky asserts that his focus is on himself and he does not want to do anything to jeopardise his freedom. He has a good understanding and awareness of his previous offending behavior and is actively taking steps to remove negative factors or dis-inhibitors, such as alcohol and drugs. In my opinion, Rocky's commitment to desist is borne of a sense of self protection, as opposed to being motivated from victim empathy, but it is nonetheless present, since this engagement it has been discussed that his sexual interests and use of torrents suggest an indicative sexual material, this is an unmoderated method of accessing adult material and as such there is a realistic risk that he may or is likely to access child abuse material. Advice has been given to him about this and ALBRONE has demonstrated throughout his management that he is willing to take on advice, as such I will grade this currently as a LOW RISK and this can be tested over time. 9. Intimate Relationship No intimate partner or relationship since the breakdown of his relationship with Sally, he is now instructing a solicitor to serve papers for a divorce. He has limited contact with Sally's son, who is now a young adult and whilst he places significant value of this relationship, it remains to be seen whether this exerts any practical or emotional influence. Rocky asserts that he is happy on his own and, whilst not completely closed to the prospect of a future relationship, he is not bothered about having one now. I am inclined to rate this category at High. 10. Employment or Positive Routine No changes, I am aware that ALBERONE details there are issues for him in this regards as he has a social anxiety for leaving his home, he believes he is likely to be attacked and would be recognised. Despite regular advice on this topic ALBERONE still maintains this stance and has made not attempts to change this. I am concerned that this may be entrenched type of thinking and despite regular advice/discussions about this- changes appear to be apparent and as such I will determine this to be a HIGH RISK. HIGH PRIORITY: to discuss employment/volunteer opportunities HIGH PRIORITY: Continue to discuss housing options as this will benefit him in his anxieties 11. Priority Rationale (This section provides the narrative for how the Priority Assessment was arrived at) ALBERONE has an entrenched set of thinking that is prevented him from developing many of the protective factors needed to effectively monitor his risk ratings. The Torrents and search terms are areas that need to be urgently discussed and reviewed on each engagement as there is a high chance of this causing him to re-offend. Police have relaxed and looking at this aera of his devices, however there is now a higher concern to forensically inspect his devices on engagements. Assessment Update Rocky has three sexual convictions, the victims being females in their teens, the offences range from Making IIOC, Cause and Incite Sexual Activity and a Penetrative Contact offence. It is noteworthy that the contact offence occurred when he was a juvenile (17yrs), when both he and the victim were in a care home environment. His antecedent history demonstrates a lack of respect for females and a willingness to be abusive and use violence against females. There is also a history of challenging relationships with ex-partners and family members. There is a very long list of Assaults/arsons, ABHs, BATTERY, CRIM DAM, and a GBH in his past. Police recently seized curved swords for destruction from his address in 2021. Realistic risk monitoring strategies He is subject to an indefinite Sexual Harm Prevention Order and is wanting this to be discharged at his end date however I would not support this being removed until efforts have been made to reduce his General risk rating. It is clear that he doesn’t want to offend again, but gloats about his “Bad” past on each engagement. He has accepted being single, for the time being and is more settled therefore. His mental health will always be an issue and his stability will no doubt fluctuate and require continued monitoring. He is not currently open to services but knows how to access them if/when needed and repeats that he needs help from police with these services however this is mostly because PPU have offered him the time when they are not responsible or knowledgeable in other agencies workings and he should seek the advice himself. He appears to be engaging in a new faith with the latter day saints- this will likely provide him with a stable group of pro-social persons, which may in turn offer him other protective factors. ALBERONE does listen to advice and has shown that he is able to focus on positive actions if directed and engaged regularly, however this comes at a high cost of officer’s time. The previous reduction in his risk rating has caused a reduction in engagements and as such ALBERONE has not benefitted of being left with a reduced visit plan.
